2. MANUFACTURING & PRODUCT DISCLAIMER

• Third-Party Manufacturing: Our products are manufactured by licensed Third-Party Manufacturers under the quality supervision of Nishkalmasha Herbals.

• Artisanal Process: We use a handmade “melt and pour” process. As a result, products may vary slightly in appearance, color, and scent. These are not defects but markers of an artisanal product.

• Ingredients: While we focus on 100% natural and herbal ingredients, we recommend a patch test before use. We are not liable for individual allergic reactions.

• Not a Medical Substitute: Our products are cosmetic/herbal in nature and are not intended to diagnose, treat, or cure any medical condition.

3. PRICING, GST & PAYMENTS

• GST: All prices are inclusive of GST as per the prevailing rates in India. A valid GST invoice will be provided for every purchase.

• Payment Gateways: We use secure, PCI-DSS compliant third-party payment gateways (e.g., Razorpay, Cashfree, or similar). We do not store your credit/debit card information.

• Modes of Payment: We accept UPI, Net Banking, Credit/Debit Cards, and Wallets. Cash on Delivery (COD) may be available for specific pin codes at our discretion.

• Transaction Failure: In case of a payment failure where the amount is deducted from your account but the order is not confirmed, the refund will be processed by your bank as per their standard timelines (usually 5-7 business days).

4. SHIPPING, RETURNS & CANCELLATIONS

• Dispatch: Orders are typically dispatched within 2-3 business days. Delivery timelines depend on our logistics partners.

• Cancellations: Orders can only be cancelled before they are dispatched. Once shipped, cancellations are not permitted.

• Returns/Refunds: Due to the personal care nature of our products, returns are only accepted if the product received is damaged, expired, or incorrect. You must provide an unboxing video as proof within 24 hours of delivery.

5. INTELLECTUAL PROPERTY RIGHTS

The brand name Nishkalmasha, all logos, product names, descriptions, and images on this website are the exclusive property of Nishkalmasha Herbals. Any unauthorized use or “passing off” of our brand identity is a punishable offense under Indian Law.

6. THIRD-PARTY MARKETPLACES

When purchasing Nishkalmasha products through Amazon, Flipkart, or Meesho, users must also abide by the terms of those specific platforms. Our liability on those platforms is limited to product quality and authenticity.

7. LIMITATION OF LIABILITY

Nishkalmasha Herbals shall not be liable for any direct, indirect, incidental, or consequential damages resulting from the use or inability to use our products or for the cost of procurement of substitute goods.

8. INDEMNIFICATION

9. GOVERNING LAW & JURISDICTION

These terms shall be governed by the laws of India. Any dispute arising out of these terms or your use of the website shall be subject to the exclusive jurisdiction of the courts in the city where Nishkalmasha Herbals is headquartered.
